You are asking people do determine if a death could've been avoided my a manufacturing design change. How difficult could it possibly be for someone to calculate all the different variables leading up to a moment of life or death. In some instances, simple. In others, not so. Asking the courts to maintain reason is ludicrous in itself. Courts are not about right or wrong, or reason for that matter. That doesn't even enter into the equation. If it did, how many of these scumbags would be getting rich off their spilled hot coffee and slip and fall lawsuits. If someone sued Porsche for this accident, and won, Porshce's insurance would pay for the judgement. Porsche (and other companies who are insured) pay into the insurance company's policies and create a pool of money. Operating costs, profit margins, and lawsuit judgements come out of this pool of money. The cost of insurance is built into everything we buy so in effect, you and I and everyone else pay's for bullshit lawsuits. In effect, you and I go to work so we can pay other lazy assholes to stay home and live marvelously off their settlements. As you may have noticed, this is a hot button topic for me.
